On September 15, 2024 at approximately 3:10 A.M., Sergeant Murphy and Officer Brogan were dispatched to the area of Essex Road on a report of a possibly intoxicated Uber driver. The caller reported that he had taken an Uber back to Essex Fells and was concerned that the driver may be under the influence. Officer Brogan located the vehicle on Essex Road and conducted a motor vehicle stop. The driver, a 41 year-old male from Newark, New Jersey, had watery eyes, slurred speech and displayed several other signs consistent with someone that may be under the influence of alcohol. Officer Brogan had the driver exit the vehicle so that he could perform standard field sobriety tests to determine whether or not he was safe to operate a motor vehicle. Upon completion of the tests, Officer Brogan determined that the driver could not operate a motor vehicle safely and he was placed under arrest for driving under the influence. He was transported back to police headquarters where he submitted breath samples for the purpose of testing. The drivers blood alcohol concentration was more than double the legal limit. He was issued several motor vehicle summonses which included driving under the influence and having an open alcohol container in his vehicle. These charges are merely allegations and the driver is presumed innocent until he is found guilty in a court of law.
