On November 28, 2024, at approximately 1:42 A.M., Officer Chiuchiolo and Officer Marta were conducting a DWI enforcement detail when they observed a vehicle on Eagle Rock Avenue with an equipment violation. Officer Chiuchiolo conducted a motor vehicle stop and identified the driver as a 46-year-old male who resides in Basking Ridge, NJ. While speaking with the driver, Officer Chiuchiolo observed several indicators of someone who may be under the influence of alcohol. The driver was asked to exit his vehicle so that he could perform several field sobriety tests to determine if he was safe to operate a motor vehicle. Upon completion of the tests, it was determined that the driver was unable to operate a motor vehicle safely and he was placed under arrest for suspicion of driving under the influence. Once in headquarters, the driver failed to provide adequate samples of his breath for the purpose of testing. He was issued several motor vehicle summonses including driving under the influence and refusal to submit breath samples. These charges are merely allegations and the driver is presumed innocent until he is found guilty in a court of law.
